All sea/ocean shipments to US sea ports have a 2 (two) part required process by US customs ISF filing and customs clearing.

 

  1. US customs requires all shipment(s) to have single ISF bond and late single ISF bond and Single Entry Bond and continuous bond are different bonds.
  1. All bond(s) are subject to final approval by our underwriter and US customs and us government agencies.
  2. If bond(s) and /or any of our service(s) are refused to importer/consignee, no expilations/reasons/causes is given to you/importer/consignee, just a refusal is given only.
  3. Single ISF bond, late single ISF bond and Single Entry Bond , can be use only once.
  4. To file your ISF , late ISF or entry and etc. , we may be purchasing it from third party, on your behalf and add it to your Invoice .
  5. Or we may use our own broker bond to file your ISF , late ISF or entry and etc. , and add it to your Invoice .
  6. If our own broker bond was use to file ISF and /or entry, the bond number will be not given to importer and /or any other info about broker bond.

  1. Single ENTRY Bond (SEB):

  1. Subject-to Single Entry Bond :
  1. Subject-to Single Entry Bond is to file entry with US customs only. Could be use only once, to view cost (click here).
  2. If your shipment is subject-to ( FDA , USDA , lacey-act, FWS , add / CVD and etc) and value is more then $200, subject-to Single Entry Bond is required.
  3. If shipment value is $200-$5000, subject-to Single Entry Bond could be done within 30 minutes (for most of shipment), (click here) to view cost.
  4. If shipment value is over $5001, could take up-to 72 hours to be approve.
  1. Continuous bond:
  1. Continuous bond eliminates most of ISF bond and late ISF bond (not on late filing fee #3) and entry bond and subject-to Single Entry Bond for next 365 days.

  3. It takes 5-8 working days (2 weeks) to be approved by us/US customs ( CBP ).
  4. If you are planning to import more then 3 or times within next 365 days, you should apply for continuous bond.
  5. If the value of your shipment is over $30,000, you should apply for continuous bond.
  6. If shipment is subject to FDA , USDA , lacey-act, FWS , any us government agencies, AD/CVD , hazard, trademark, patent and etc. You should apply for continuous bond.
  7. If your shipment is subject-to shipments (add / CVD , hazard and etc,. ) it is possible for surety bond company to reject the applicate.
  8. US customs / us government agencies / surety bond company can cancel/terminate your bond, any time, any where and for any reason.
  9. All premiums fully earned: no pro-rate o/ no refund(s) / no cancellation for any bond(s) and /or ISF is filing/filed and /or entry filing and /or any of other service on our website.
  10. If US customs / any us government agencies / your surety bond company to increase your bond amount, no pro-rate and /or no refund(s) is given, you must apply for new bond and pay for other year, if new bond is approve.

Note: If US customs and /or any other us government agencies finds any violation/misleading/missing information of importation and etc, US customs may confiscate/penalize/fines/recall/examine/re- ISF -filing and re-entry-filing the us importer/exporter shipment(s) and recall the us importer/exporter, anytime, up-to 5 years. Please disclose detailed descriptions of shipment on all documents ( Invoice , Packing List , Bill of Lading and etc. ) with HTC / HTS code, material that is made out of and etc. Importers/exporter are responsible for all fees (click here) and us/international laws ( CBP . Gov) example: CBP action without notification backdated duty/tax (click here) if US customs decided to confiscate/seize/penalize/fines/examine/recall, request of information's and /or for violation, misleading, incomplete, late ISF filing, customs entry filing and etc. If any, US customs will notify you by email/phone/mail/letter within 1-12 month (normally). Also, US customs may contact us to relay the letter/message to you. If so, you must pay US customs ASAP . Otherwise US customs/government agencies will/may add interest, other-fines, black-list you, visiting you and etc. "only consignee is responsible for documents, all fees, us laws and international laws.

Customs and border protection to begin enforcing import security filing on July 9, 2013: Customs and border protection ( CBP ) announced that they will begin full enforcement of importer security filing ( ISF ) regulations on july 9, 2013 and will start issuing liquidated damages against ISF importers and carriers for ISF non-compliance.

Late or inaccurate ISF transmissions: CBP will assess liquidated damages in accordance with the relevant mitigation guidelines which were published in the CBP bulletin on July 17, 2009. There can be multiple errors on an ISF transmission and in accordance with the guidelines, CBP may assess / fines a claim for liquidated damages as follows:

  • $5,000 per late ISF
  • $5,000 per inaccurate ISF , and
  • $5,000 for the first inaccurate ISF update.

Additional statutory penalties may be assessed for serious or repetitive violations.

Failure to file an ISF: Because liquidated damages cannot be assessed for the failure to file an ISF if no bond is in place, CBP will withhold the release or transfer of the cargo until CBP receives the required ISF information and has had the opportunity to review the documentation and conduct any necessary examination. CBP also reserves the right to not permit unlading of merchandise for which no ISF has been filed, and, if such cargo is unladen without permission, it may be subject to seizure.

Statute of limitations: Pursuant to 28 US C. § 2415, the statute of limitations for ISF liquidated damages is six years from the date of the breach of the bond. CBP will not limit its authority to enforce the ISF requirements.

Mitigation guidelines: First violation: if an ISF importer incurs a liquidated damages claim for filing a late or inaccurate ISF or an inaccurate ISF update, the liquidated damages claim may be cancelled upon payment of an amount between $1,000 and $2,000, depending on the presence of mitigating or aggravating factors, if CBP determines that law enforcement goals were not compromised by the violation.

Subsequent violations: if an ISF importer incurs a subsequent liquidated damages claim for filing a late or inaccurate ISF or an inaccurate ISF update, the liquidated damages claim may be cancelled upon payment of an amount not less than $2,500 if CBP determines that law enforcement goals were not compromised by the violation. No relief will be granted if CBP determines that law enforcement goals were compromised by the violation.

Additional mitigation for C-TPAT participants: an ISF importer which is a certified tier 2 or tier 3 C-TPAT member may receive additional mitigation of up to 50% of the normal mitigation amount, depending upon tier of C-TPAT participation.
